6. Usage rights

When purchasing an artwork, the artwork’s economic rights are transferred from the visual artist to the buyer in accordance with the Finnish Copyright Act (404/1961) and international copyright conventions.

If the artwork is marked as unique (1/1), the economic rights are transferred to the buyer on an exclusive basis, and the artwork will not be sold to other buyers. For other artworks, the economic rights are transferred on a non‑exclusive licence, meaning the same artwork may be sold to multiple buyers.

The economic rights are transferred to the buyer only after the payment has been received and the chosen payment method has been successfully charged. The transfer of rights does not occur at the moment of placing the order, but only after a successful charge.

After a successful charge, the buyer receives the following economic rights:

  • to create copies of the artwork
  • to distribute, publish, and transfer the artwork
  • to use the artwork commercially and for any other lawful purpose without restriction
  • to use the artwork without additional licensing fees

If the seller is required to refund the payment to PayPal or to the buyer, all economic rights transferred to the buyer will immediately cease and revert fully to the artist. In such a case, the buyer must immediately stop using the artwork and delete all copies and publications of the artwork in any form or medium, including but not limited to physical and digital copies as well as blockchain‑stored or tokenised versions. The buyer must also ensure that all third parties who received the artwork through the buyer cease using it and delete all copies and publications in their possession.

7. Artist’s rights

Even when economic rights are transferred, the artist’s moral rights to the artwork remain in force. The buyer may not remove or alter the signature included in the artwork. The buyer may also not present the artwork in a manner that harms the artist’s artistic value or reputation.

The artist retains a non‑exclusive and perpetual right to display the artwork in the following contexts:

  • the artist’s social media channels
  • the artist’s website and online store
  • the artist’s portfolio
  • the artist’s studio
  • short‑term exhibitions and other short‑term presentation contexts

This retained display right does not limit the buyer’s rights to the artwork, nor does it grant the artist the right to resell an artwork marked as unique (1/1).

8. Right of withdrawal and returns

The buyer has no right of withdrawal or return, as the product is digital content delivered immediately to the buyer.
